I. SUBJECT AND GENERAL CONDITIONS
1. The present General Terms and Conditions define the relationships of the BCause Foundation with its givers - natural and legal persons.
2. "Giver", within the meaning of these General Terms and Conditions, is any natural or legal person who has entered into a Grant Agreement with the Foundation on a single time or regular basis.
3. "Beneficiary", within the meaning of these General Terms and Conditions, is a natural or legal person in favour of which the Foundation grants a certain amount in accordance with the will of the giver specified in his individual contract with the Foundation.
4. These Terms and Conditions are binding for the Foundation and for the givers who certify this with their signature under the Grant Agreement. Givers shall be deemed to have been informed of the same from the date of their publication under the provisions of paragraph 28 below.
II. INDIVIDUAL DONATION AGREEMENT
5. The Foundation shall conclude a written contract with the persons wishing to make a donation. Exceptions are made by those who made anonymous donations and unwilling to sign contracts during campaigns with boxes for donations or publicly disclosed bank accounts.
6. In the contract the givers provide in writing the following information about themselves:
6.1. For individuals - PIN, number and date of issue of a valid Bulgarian identity document and permanent address of the person on the territory of the Republic of Bulgaria.
6.2. For legal persons and sole traders - number of the tax registration and of BULSTAT registration, address of management, full names of the official representative, competent to sign the contract.
6.3. For donations of over BGN 30 000 the Foundation requires additional documents in accordance with the Foundation's Internal Rules for the Control and Prevention of Money Laundering and Funding of Terrorism.
7. The giver chooses and indicates which cause he will support.
III. MANAGEMENT OF CONTRACTS 'DONATIONS
8. The Foundation deducts funds from the amounts donated by the GIVER to the purpose of achieving self-financing and sustainability of services to the givers.
9. The Foundation uses deducted funds to manage donations, and in particular to:
9.1. Selection of beneficiaries, including through an invitation and an open competition
9.2. Monitoring and control
9.3. Reinforcement of beneficiaries through appropriate activities - training, consultations, promotion activities
9.4. Keeping the givers informed
9.5. Annual reporting
10. The amount of management resources shall be determined in the specific contract. Where no explicit size is specified, the Foundation applies 10% of the donation amount.
IV. RIGHTS OF THE GIVER
11. To use the services of the Foundation in accordance with the requirements of these General Terms and the Grant Agreement.
12. To modify by written application his donation contract, including the amount of his monthly donation contributions, as well as the specific cause for which they are to be directed.
13. To receive on request (outside the order of item 21 of these General Terms and Conditions) information from the Charity Foundation, about the charity made with his donations, as well as information on the Foundation's overall activity.
14. To indicate to a designated place in the contract that he does not want his name to be disclosed to third parties.
V. OBLIGATIONS OF THE GIVER
15. To comply with the conditions of these Terms and Conditions and the Grant Agreement.
16. To inform the Foundation about any change in its name, address or other registration data collected for the purpose of issuing an official note on donations made to the Foundation during the year.
VI. RIGHTS OF THE FOUNDATION
17. To make changes in the technology or structure of different givers services and to extend the scope of giver services.
18. To make public the names of its givers, except in the cases of item 14 of these General Terms and Conditions.
19. To communicate with givers who have ceased participating in the "More - More" initiative due to another job to invite them to renew their contract once they have settled with their new employer.
VII. OBLIGATIONS OF THE FOUNDATION
20. To provide quality management and organizational service to the various giving services in accordance with these General Terms and Conditions and the individual Grant Agreement.
21. To distribute the received donations correctly to the benefit of the final beneficiaries, observing the written will of the givers.
22. To publish regularly information about the funds allocated on its website and by March 31 to inform by e-mail about the total value of the charity work done during the year with all donations.
23. To publish annually its annual report by the end of June.
24. To ensure the anonymity of givers in accordance with item 14 of these General Terms and Conditions.
25. The Foundation shall not be held responsible to its givers if, after targeting their intended donations to a giver selected final beneficiary, the beneficiary shows an irregularity or misuse of the funds. In such cases, the Foundation is obliged to remove as soon as possible the problems encountered in the implementation of the giver's will by communicating openly and actively with the givers.
VIII. TERMINATION OF THE GRANT AGREEMENT
26. The effect of regular donation contracts may be terminated unilaterally by the giver with a one-week written notice to the Foundation.
IX. ENTRY INTO FORCE
27. The present General Terms and Conditions shall enter into force on 01.04.2013, and one week before that date the Foundation shall publish them on the Internet at: www.bcause.bg
X. CHANGES IN THE GENERAL TERMS AND CONDITIONS
28. Upon change of these General Terms and Conditions, the Foundation shall inform the givers of this no less than one week prior to their entry into force.
XI. RIGHTS OF EXISTING GIVERS
29. These General Terms apply also to the existing givers on the date of entry into force.
XII. APPLICABLE LAW
32. Bulgarian law shall apply to the application and interpretation of these General Terms and Conditions.
